NON-COMPLIANCE / FAILURE TO COOPERATE WITH ABF DECISIONS
A failure to comply arises when the intermediary:
fails to comply, in whole or in part, with the decision of the Italian Banking and Financial Ombudsman (ABF)
fails to reimburse the €20 filing fee to the customer, even in the event of a partially successful appeal
fails to remit to the Bank of Italy the filing fee due if the appeal is upheld, even if only in part
A failure to cooperate with the procedure arises, but it is not limited to, in the following cases:
repeated failures to send the documentation relevant to the assessment of the appeal
failure to submit the documentation required by the Panel
failure to pay the fees due to the Panel members appointed by the intermediaries' associations.
