NON-COMPLIANCE / FAILURE TO COOPERATE WITH ABF DECISIONS

A failure to comply arises when the intermediary:

  • fails to comply, in whole or in part, with the decision of the Italian Banking and Financial Ombudsman (ABF)

  • fails to reimburse the €20 filing fee to the customer, even in the event of a partially successful appeal

  • fails to remit to the Bank of Italy the filing fee due if the appeal is upheld, even if only in part

A failure to cooperate with the procedure arises, but it is not limited to, in the following cases:

  • repeated failures to send the documentation relevant to the assessment of the appeal

  • failure to submit the documentation required by the Panel

  • failure to pay the fees due to the Panel members appointed by the intermediaries' associations.
